TERMS OF USE

SECTION I: INTRODUCTION

General information

The domain www.choffers.com (hereinafter the “COMPANY”) with all its sub-domains bikers.choffers.com and partners.choffers.com (hereinafter the “BRANDS”) and the corresponding mobile applications (hereinafter the “APPS”) are all property of EGA Global Services SL (hereinafter the “GROUP”) domiciliated at CarrerMúsic Serrano, 11, 03560 El Campello – Alicante and with the contact email address info@choffers.com.

These Terms of Use, together with our Privacy Policy, Frequently Asked Questions (FAQs) and Cookies Policy, (hereinafter, “Terms of Use”) establish access and use as a User (hereinafter, the “User”) to all the COMPANY’s websites (choffers.com, bikers.choffers.com, partners.choffers.com (also branded as easybno.com)) and the corresponding mobile applications (hereinafter jointly referred to as the “PLATFORM”). If you register on the PLATFORM or simply browse through its contents, it means that you accept without exception these Terms of Use.

The User declares to be a natural person, over 18 years of age and have the capacity to accept these Terms of Use. In the event of acting on behalf of any third party, natural or legal person, the User declares that they have sufficient and valid authorization.

The User assumes responsibility for the use of the PLATFORM. This responsibility extends to the registration that is necessary to access certain services or content. In said registration, the User will be responsible for providing true and lawful information. As a consequence of this registration, the User will obtain a password for which he will be responsible, committing himself to make diligent and confidential use of it. The personal data that you may provide while browsing the PLATFORM will be incorporated into the automated files for which the GROUP is responsible and in order to be able to manage the requests, as well as the sending of information by any means.

Definitions

CUSTOMERS: These are users to the PLATFORM who buy or book the products or services of the COLLABORATORS and PARTNERS.

COLLABORATORS: These are independent professionals (bikers and chauffeurs) registered on the PLATFORM and offering their services on demand to users of the PLATFORM.

PARTNERS: These are local businesses partnering with the COMPANY to sell their services to users of the PLATFORM and also to hire on demand the services of the COLLABORATORS.

GIGS: These are short term jobs on demand posted by CUSTOMERS on the platform.

BOOKINGS: These are purchased services made by CUSTOMER from and offered by COLLABORATOR.

ORDERS: Request to buy or book products or services from the CUSTOMERS to the PARTNERS.

How it works

Only registered users may buy and sell on Bikers & Choffers. Registration is free. In registering for an account, you agree to provide us with accurate, complete and updated information and must not create an account for fraudulent or misleading purposes. You are solely responsible for any activity on your account and for maintaining the confidentiality and security of your password. We are not liable for any acts or omissions by you in connection with your account.

CUSTOMERS pay the PLATFORM in advance to make a booking (see Payment Terms).

Booking can be made via the COLLABORATOR’S profile page or on the applied GIG page via CUSTOMER account.

For fees and payments please read the Payment Terms.

COLLABORATORS must fulfill their confirmed BOOKINGS, and may not cancel BOOKINGS on a regular basis or without cause. Cancelling BOOKINGS will affect COLLABORATOR`S’ reputation and status.

COLLABORATORS should in no circumstances negotiate directly with the CUSTOMER without the COMPANY’S consent.

User Accounts

Each account must be a personal account but users may operate as an individual or a company or any other legal entity (whether incorporated or unincorporated).

Users cannot register for more than one account.

We reserve the right to restrict your access, temporarily or indefinitely block your account, and stop any gigs you have in progress, warn other CUSTOMERS, COLLABORATORS and partners of your actions or issue you a warning if:

  • You breach the letter or spirit of these terms;
  • We are unable to verify or authenticate any information you provide to us;
  • We believe that your actions may cause any loss or liability to our users or to us.

Users are solely responsible for any activity that occurs on their account, unless it is a result of actions beyond their control for instance hacking. Users may never use another person’s user account or registration information for the website.

SECTION II: CUSTOMERS

Basics

You may not offer direct payments to COLLABORATOR using payment systems outside of the PLATFORM.

Bikers & Choffers retains the right to use all publicly published delivered works for Bikers & Choffers marketing and promotional purposes.

CUSTOMERS may book directly on COLLABORATOR’S profile page or post a GIG.GIGS posted on the PLATFORM by CUSTOMERS must be an allowed service on the PLATFORM. Please click here for guidelines on approved services.

Booking a service

It’s important to note that Bikers &Choffers is simply a marketplace which connects you to independent professionals or companies (COLLABORATORS) looking to do an on-demand jobs or errands. As much as we can intervene to arbitrate to resolve dispute etc. we take no responsibility should anything go wrong. The said COLLABORATOR is liable and takes full responsibility.

That said, to book a service on Bikers &Choffers, you can book directly on the COLLABORATOR’S profile page or request a quote. Also, you can book by publishing your errands or logistic tasks (also called gig) like food/grocery deliveries, airport transfers etc. And within minutes you’ll start receiving bids/offers from our COLLABORATORS to do the task. All you need to do is accept an offer, pay and you’re good to go!

Protection for CUSTOMERS

Bikers & Choffers will make adjustments to the invoice issued to the CUSTOMER for work that is not clearly related to either the gig requirements or CUSTOMER’S instructions in the platform and within the authorized timeline for delivery, subject to and conditioned on the following terms:

  • CUSTOMER must have an Account in good standing and at least one valid and authenticated payment method, and CUSTOMER must agree to automatically pay the COLLABORATOR for work already done on a pro-rata basis.
  • COLLABORATOR’s Account must be in good standing.

In addition to that you are obligated to abide by the following terms at all material times by promising that you:

  • Are able to pay for the services you seek from the COLLABORATOR;
  • You are not in breach of any applicable laws, rules or regulations or obligations to any other person;
  • You have made and will make all required legal and tax filings;
  • You shall not (and shall not permit) any third party to either take any action or upload, download, post, submit or otherwise distribute or facilitate distribution of any content through Bikers & Choffers including without limitation any user content that infringes any patent, trademark, trade secret, copyright or other rights of any other person or entity or violates any law or contractual duty.

Payments

Payments are only made for gigs that the CUSTOMER has agreed to have been successfully completed. For the gigs, the COLLABORATOR must not request a release of funds being held from the escrow account prior to completion of the gig; the purpose of funds being held in the escrow account is to provide the COLLABORATOR with the security needed for them to undertake the gig. CUSTOMERS must report such cases immediately. In such cases the COLLABORATOR’S account may be temporarily or permanently suspended.

All payments between the CUSTOMER and COLLABORATOR must be processed through processed through Bikers & Choffers. Payment (or attempt of) outside of Bikers & Choffers is a breach of these terms unless the prior express written consent of Bikers & Choffers has been obtained. Such payment (or attempt of) will lead to temporary and/or permanent suspension of the CUSTOMER and/or COLLABORATOR’S account. The COLLABORATOR will be liable for any loss of business and legal expenses that Bikers & Choffers may incur in recovering it. Bikers & Choffers reserve the right to sanction funds held in the COLLABORATOR’S account in order to recover lost fees. In addition to that, Bikers & Choffers will not mediate any disputes or be liable to either CUSTOMER or COLLABORATOR’S loss of business as a result of violation of this clause. Users must report attempts or offers to make payment outside of Bikers & Choffers by their CUSTOMER or COLLABORATOR to Bikers & Choffers immediately.

Payments by CUSTOMERS are routinely checked by Bikers & Choffers for fraud prevention purposes, before any payments are released to the COLLABORATOR. Bikers & Choffers aims to process these payments and credit funds to the COLLABORATOR’S account within three working days; however Bikers & Choffers reserve the right to take up to ten working days.

Leaving Feedback

When the gig is completed and the COLLABORATOR has been paid by the CUSTOMER, we normally ask the CUSTOMER to provide qualitative feedback and a rating from 1-5 of the COLLABORATOR. This rating influences the COLLABORATOR’S account on Bikers & Choffers. The feedback is published on the COLLABORATOR’S profile.

The CUSTOMER is required to complete the feedback honestly. The CUSTOMER must not falsify feedback, manipulate or coerce the COLLABORATOR by threatening negative feedback. Any attempts of this nature should be reported immediately to Bikers & Choffers.

Feedback comments that are reported to us as defamatory, abusive or offensive will be reviewed and may be removed at our discretion.

Refund

A CUSTOMER is entitled to receive a refund of funds held in the escrow account under the following circumstances:

  • No response: the COLLABORATOR has not responded to the CUSTOMER’S request within one working day of the commencement of the gig.
  • Non-delivery: the time agreed upon has lapsed and the COLLABORATOR has not delivered the gig.

Poor Quality: the deliverables provided by the CUSTOMER must be met.

COLLABORATOR and CUSTOMER may actually agree to a refund for reasons other than the ones indicated herein above. Refunds are only applicable to funds held in the Escrow Account.

SECTION III: COLLABORATORS

Basics

You may not offer direct payments to COLLABORATOR using payment systems outside of the PLATFORM.

Protection for COLLABORATORS

In the rare event that a CUSTOMER refuses payment for legitimate services performed by a COLLABORATOR, Bikers & Choffers will provide limited payment protection to the COLLABORATOR as mentioned below. Bikers & Choffers payment protection will be provided only if all of the following criteria are met:

  • CUSTOMER must have an account in good standing and at least one valid and authenticated payment method, and CUSTOMER must agree to automatically pay for hours worked by the COLLABORATOR.
  • COLLABORATOR’S Account must be in good standing.

Quality

All COLLABORATORS on Bikers & Choffers must strive to deliver a high standard of work, appropriately meeting the CUSTOMER’S needs.

Specifically, COLLABORATORS must ensure that all deliverables are:

  • Error free.
  • Fully address each of the CUSTOMER’S defined requirements.
  • Are a complete set of deliverables.
  • Are of a standard consistent with the level of expertise indicated in the COLLABORATOR’S profile.

Funds Withdrawal

To withdraw funds from their Bikers & Choffers Account, a CUSTOMER needs to request a withdrawal on an authorized withdrawal account. An authorized withdrawal account can be either:

  • A bank account under the user’s name as registered on his profile.
  • A paypal account with the same name as registered on the user’s profile and an email address that has been verified by the user.

For security reasons, Bikers & Choffers reserves the right to request additional information from COLLABORATORS including original documents, and to verify documents with issuing institutions. Therefore, we reserve the right to request the following proofs of identity:

  • A copy of a Government issued ID (Passport, Driver’s License or National ID Card).
  • A copy of a recent utility bill showing your name and address (less than 3 months old).

SECTION IV: PARTNERS

Service and Charges

Subject to terms contained herein, the PARTNER agrees to make himself/herself/itself available to Bikers & Choffers platform to undertake services as and when a request for the same is placed through the Bikers & Choffers platform.

PARTNER agrees and acknowledges that upon acceptance of an offer for a service, services undertaken by the PARTNER shall constitute a separate contract to which Bikers & Choffers is not a party.

At the time of availing himself/herself/itself for the first time on the Bikers & Choffers platform, the PARTNER shall at the discretion of Bikers & Choffers be required to pay a fee.

PARTNER information

Bikers & Choffers may collect the PARTNER’S information at the time of execution of these terms or at any time thereafter, to establish the identity of the PARTNER. Bikers & Choffers reserves the right to store, process, access and use the PARTNER’S information for business purposes and needs, background checks, verification, marketing, development, analytic, research and any other purpose as Bikers & Choffers may deem fit and in accordance with applicable law.

Subject to applicable law, Bikers & Choffers may provide a third party, governmental agency, judicial body, any PARTNER information relating to the services, if there is a complaint, dispute or conflict.

Disputes and Cancellations

We encourage our CUSTOMERS and COLLABORATORS to try and settle conflicts among themselves. If for any reason this fails after using the Resolution Center or if you encounter non-permitted usage on the Site, users can contact Bikers & Choffers customer support department for assistance here.
